Returns & Exchanges

At Cypress Furniture, we have a no returns or exchange policy and all sales are final. Cypress Furniture sells brand-new merchandise only; therefore, we are not able to take back any furniture that has been used. Also, we are very mindful about sanitary/health issues & do not bring used merchandise back into our warehouse. Once your invoice has been signed and/or initialed, cancellations can not be made for any reason. Refunds are not given for any reason on any invoice. There are no refunds on special orders.

 

Cancellation

However, with the approval of upper management, there will be a 25% cancellation fee of the entire invoice amount on all cancelled orders.

 

Special Orders

If a customer places a special order, the invoice must be paid in full before the merchandise can be ordered.

 

Taxes

Buyer is responsible for any tax or governmental charge imposed upon the sale or transfer of any product. Any such tax or governmental charge will be added to the total invoice amount. All prices are FOB Seller’s facilities. Applicable freight costs will be added to the invoice.

 

"As is" Items

At Cypress Furniture, we periodically offer "as is" items that are going out of stock or being discontinued at an exclusively low price. For these items, our traditional one year warranty is voided and no longer applicable to any items purchased from the floor of our store or website marked "as is". No returns are allowed on all "as is" items. We are happy to offer an extended warranty for "as is" items at an additional cost. Ask your sales associate about our 5 year extended warranty plan prior to purchase. If an extended warranty is not purchased, Cypress Furniture is not responsible for any future malfunctions, damages, or defects to the item.

 

Warranty and disclaimer

Cypress Furniture understands that your new furniture is an investment. Once it’s set up in your house, you want to keep it there for a long time to come. That’s why we only stock the best furniture the world has to offer and stand behind it.

 

Limitation of liability

We provide a free one year in house warranty that is only limited to manufacturer’s defects, which does not include accidental damages, spills, rips, tears, etc. Damages on furniture that are caused by everyday use such as water damage, scratches, rips or even cracks are not covered by Cypress Furniture’s 1 year manufacturer’s warranty. For occurrences like these, we sell a five year extended warranty that has to be purchased at the time the furniture is purchased.

Leather Furniture must NOT be cleaned by any type of chemical products. Cypress Furniture does not cover any damages caused by the negligence of the customer. Federal law mandates that mattresses still have their tag intact and has no stains of any sort on the mattress otherwise the mattress warranty will be voided. To protect your mattress warranty, Cypress Furniture sells received your product in good condition at the time of delivery, and you do not notify the store about any defects within the first 24 hours, you will have to contact the manufacturer yourself.

 

Indemnity

Buyer shall defend, indemnify and hold harmless Seller and its affiliated or related companies from and against any and all claims, losses, liability, damages and expenses including, but not limited to, attorneys’ fees and cost of defense arising from, related to or in any way connected with or alleged to arise from or out of any asserted deficiencies or defects in Product caused by any alteration or modification thereof by Buyer with or without Seller’s consent, or improper handling or storage by Buyer, the breach of any term or condition stated herein, Buyer’s failure to label Product or Buyer’s improper labeling of Product regardless of whether the labeling was done with or without the advice of Seller, or any act or omission of Buyer including any Claims for or resulting from any injury to person (including death) or damage to property or for economic loss, several or comparative negligence, breach of agreement, breach of warranty or other breach of duty of or by Indemnitee or as a result of Indemnitee’s strict or other product liability. The foregoing indemnification shall not be construed to eliminate or in any way reduce any other indemnification or right which Indemnitee has by law.

 

Payment

Cypress Furniture accepts all Major Credit Cards. Cypress Furniture Store Card, Cash & Debit, In-Store 3rd Party Financing.

 

Governing law and arbitration

This document shall be interpreted and governed by the law of the State of America. Harris County, Texas, excluding its conflicts of laws rules. The parties specifically exclude the application of the United Nations Convention on the Sale of Goods.
